1. Agreement to Terms

These Terms of Service (“Terms”) form a binding agreement between you (an individual or entity, “you”) and Koset.io (“Koset.io,” “we,” “us,” or “our”) governing your access to and use of our website, platform, mobile applications, and related services (collectively, the “Platform”). Koset.io is registered in India, with its principal place of business at Koset.io, Sector 31, Gurgaon, Haryana, India.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you must discontinue use immediately.

We may update these Terms occasionally and will indicate the Last updated date. Continued use of the Platform after changes signifies your acceptance of the updated Terms.

You are responsible for ensuring compliance with local laws when using the Platform. The Platform is not tailored for regulated industries (e.g., healthcare or finance). Users under 18 years old are not permitted.

 

2. Definitions

• Host: A user who lists GPU hardware on the Platform for lease.

• Client: A user who leases GPU hardware listed by Hosts.

 

3. Platform Description

​

Koset.io operates a GPU leasing marketplace that connects Hosts (who offer GPU hardware) with Clients (who lease available GPU resources). We act solely as a facilitator and are not a provider of the hardware or compute services itself.

 

4. Intellectual Property

​

All content on the Platform—code, visuals, trademarks, and documentation—is owned or licensed by Koset.io and is protected under Indian and international intellectual property laws. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform in accordance with these Terms.

 

5. User Representations

​

By using the Platform, you represent that:

• Your registration information is accurate and up-to-date.

• You are legally capable of entering into this agreement and are not a minor.

• Your use of the Platform is lawful.

• You will not use automated tools (bots, scripts) to interact with the Platform.

• You will abide by all applicable laws.

We reserve the right to suspend or terminate accounts with false or suspicious information.

 

6. Account Registration

Registration may be required to access leasing features. You must keep your login credentials secure and are responsible for all activities under your account. We may reject or reclaim usernames deemed inappropriate.

 

7. Marketplace Listings & Transactions

​

• Hosts set terms, descriptions, and pricing for their hardware. Clients enter into lease agreements with Hosts via our Platform.

• Koset.io reserves the right to suspend listings that violate policies or appear fraudulent.

• Pricing, availability, and hardware descriptions are subject to change without notice.\

8. Payments & Fees

​

• Clients pay lease fees through payment methods supported on the Platform [credit/debit cards, UPI, PayPal, or other methods mention in website is applicable).

• Hosts receive payouts per the payout schedule, subject to Platform fees and local tax withholding.

• You agree to provide accurate billing information and promptly update payment details.

• Koset.io may adjust Platform fees or payment terms at its discretion.

9. Refunds & Cancellations

​

• Lease agreements are binding. Refunds are issued under limited circumstances, such as Host cancellation or hardware unavailability.

• No refunds on any purchases—all sales are final. You must plan before spending. We recommend you to start with small initial top-ups  to test the service and then buy the plan.

• Refunds for any unspent credit balance may be available in our sole discretion depending on the payment method.

 

10. Prohibited Activities

 

Users must not:

• Misrepresent, defraud, or deceive other users or Koset.io

• Access unauthorized accounts or systems.

• Upload harmful software (viruses, malware).

• Scrape, mine, or copy Platform data unlawfully.

• Harass or threaten others.

• Lease in violation of applicable laws or export controls. Violation may result in account termination and legal action.

11. Host–Client Interaction

​

Koset.io acts only as the intermediary. Hosts and Clients communicate and transact directly for hardware usage, terms, and support. Koset.io is not responsible for:

• Host hardware reliability.

• Client conduct during usage.

• Any damages arising from the Host–Client relationship.

12. Privacy

​

Our Privacy Policy governs data collection and use. Users consent to the processing of personal data in India and other regions as necessary to deliver services. Please review it carefully.

 

13. Termination

​

Koset.io may suspend or terminate accounts or access for violations or at its discretion. Termination does not relieve outstanding obligations. Terminated users may be banned from re-registering.

14. Modifications & Service Interruptions

We may modify or discontinue the Platform at any time without liability. Scheduled or emergency maintenance may cause interruptions; Koset.io is not liable for resulting inconvenience or data loss.

 

15. Disclaimers

The Platform and services are provided "as is," without warranties of any kind. Koset.io disclaims liabilities for:

• Hardware performance or suitability.

• Data loss, downtime, or inaccuracies.

• Unauthorized access to systems.

 

16. Limitation of Liability

 

To the extent permitted by applicable law, Koset.io and its affiliates are not liable for indirect, incidental, special, or consequential damages, including lost profits, data, or business interruption—even if advised of the possibility. Liability is capped at the amount paid by the user in the previous six months (or INR equivalent).

17. Indemnification

​

You agree to indemnify and hold Koset.io and affiliates harmless from any claims arising from your use of the Platform, breach of these Terms, or your misconduct.

18. Governing Law & Dispute Resolution

​

These Terms are governed by the laws of India, without reference to conflict-of-law principles. Disputes arising hereunder shall be resolved by arbitration in Delhi, under the Indian Arbitration and Conciliation Act, 1996. Arbitration shall be final and binding. If arbitration is not allowed, disputes will be resolved in courts in Gurgaon, Haryana.

 

19. Severability & Waiver

If a provision is deemed unenforceable, the rest remain in effect. Failure to enforce any right is not a waiver thereof.
